Welcome to Derek Kelley Art. By accessing our website, www.derekkelleyart.com, or purchasing artwork through our online store, you agree to the following Terms & Conditions.
Please review these terms before placing an order.
1. Artwork and Product Information
Derek Kelley Art LLC offers original works of art and limited-edition fine-art prints created by artist Derek Kelley.
We strive to provide accurate descriptions, dimensions, photographs, and pricing for all artwork displayed on our website.
Colors, tones, textures, and other visual details may appear slightly different depending on your screen settings. Minor variations between the artwork displayed online and the physical piece are not necessarily considered defects.
All artwork is subject to availability.
2. Original Artwork
Original artworks are unique, one-of-a-kind creations.
Each original artwork is sold as described in its product listing, including its dimensions, medium, and framing status, where applicable.
Unless expressly stated otherwise, the purchase of an original artwork includes ownership of the physical artwork only. Copyright and reproduction rights remain with the artist.
Shipping arrangements and costs for original artwork are determined individually based on the artwork's size, framing, value, and destination.
Customers are encouraged to contact us before purchasing an original artwork to discuss shipping or local pickup arrangements.
3. Limited-Edition Fine-Art Prints
Our limited-edition prints are professionally produced using archival pigment printing methods and fine-art materials.
Each edition is strictly limited to 100 prints per artwork.
Every limited-edition print is:
Personally signed by Derek Kelley.
Individually numbered within its edition.
Accompanied by a Certificate of Authenticity.
Produced on archival-quality fine-art paper.
Edition numbers are assigned by the artist and may not be selected by the purchaser unless specifically agreed upon before purchase.
Once an edition of 100 prints has sold out, no additional prints will be produced as part of that numbered edition.
The artist retains all copyrights and reproduction rights associated with the artwork.
4. Pricing and Payment
All prices displayed on our website are in U.S. dollars.
Applicable sales taxes and shipping charges are calculated and displayed during checkout.
Payment must be completed before an order is processed.
We reserve the right to correct pricing errors, inaccurate descriptions, or other listing mistakes. If an error affects an order that has already been placed, we will contact the customer to explain the issue and offer an appropriate resolution, including cancellation and a refund where applicable.
5. Promotional Offers and Discount Codes
From time to time, Derek Kelley Art may offer promotional discounts or special pricing.
Promotions are subject to their advertised eligibility requirements, expiration dates, and usage limits.
Unless otherwise stated:
Discount codes apply only to eligible artwork.
Discounts do not apply to shipping charges or sales taxes.
Only one discount code may be used per order.
Promotional offers cannot be combined.
Discounts have no cash value and cannot be applied retroactively.
We reserve the right to discontinue or modify promotions prospectively, subject to applicable law and any commitments already made to customers.
6. Order Processing and Fulfillment
Limited-edition prints are produced to order.
Please allow approximately 7–10 business days for production, inspection, signing, numbering, and packaging before shipment.
Processing times are estimates and may vary due to production schedules, holidays, or unforeseen circumstances.
If a significant delay occurs, we will make reasonable efforts to notify the customer.
Original artwork may require additional time for professional packaging and shipping arrangements.
7. Shipping and Delivery
Limited-edition prints are shipped flat using protective packaging designed to minimize damage during transit.
A flat shipping charge of $25 per order applies to eligible destinations within the contiguous United States, as indicated during checkout.
Shipping costs for original artwork are quoted individually.
Tracking information will be provided when available.
Delivery dates are estimates and may be affected by shipping carriers, weather, or other circumstances outside our control.
Customers are responsible for providing accurate shipping information. If an incorrect address results in additional shipping expenses, we may contact the customer to arrange payment of those costs before reshipment.

8. Returns, Cancellations, and Damaged Artwork
Because limited-edition prints are produced to order, we generally do not accept returns or exchanges due to changes of mind.
Cancellation requests must be submitted before production begins. Once production has started, cancellation may no longer be possible.
Original artwork sales are generally final, subject to applicable law and the circumstances described in our Shipping & Returns Policy.
If artwork arrives damaged, defective, or incorrect, please contact us promptly, preferably within 48 hours of delivery, with photographs of the artwork and packaging.
We will review the issue and work toward an appropriate resolution, which may include repair, replacement, or refund.
Nothing in these terms limits rights or remedies that cannot legally be excluded.
9. Copyright and Intellectual Property
All artwork, images, photographs, text, designs, and other original creative content displayed on this website are protected by applicable intellectual property laws.
Unless expressly stated otherwise, copyright in artwork created by Derek Kelley remains with Derek Kelley.
Purchasing an original artwork or limited-edition print transfers ownership of the physical item only. It does not transfer copyright, reproduction rights, licensing rights, or other intellectual property rights.
Without prior written authorization, artwork may not be reproduced, copied, distributed, commercially displayed, licensed, or used to create derivative products, except as permitted by applicable law.
Collectors are welcome to display their purchased artwork for personal enjoyment and may resell the physical artwork, subject to applicable law.

10. Certificates of Authenticity
Certificates of Authenticity are provided with limited-edition prints to document their authenticity and edition information.
Collectors are encouraged to retain their certificates as part of the artwork's provenance and ownership documentation.
A Certificate of Authenticity does not transfer copyright or reproduction rights.
11. Website Use
Visitors agree not to use this website for unlawful purposes, interfere with its functionality, attempt unauthorized access, or misuse its content.
We reserve the right to restrict access or decline transactions where reasonably necessary to prevent fraud, unlawful activity, or misuse of our services.
12. Limitation of Liability
To the extent permitted by applicable law, Derek Kelley Art LLC is not responsible for indirect, incidental, or consequential losses arising from the use of this website or purchases made through it.
Nothing in these terms excludes or limits liability that cannot legally be excluded or limits any mandatory consumer protections.
13. Privacy
We respect the privacy of our customers and website visitors.
Information collected through our website is handled in accordance with our Privacy Policy.

14. Changes to These Terms
